Visit the CEIVA Referral Program page in your CEIVA member account to tell your friends about CEIVA. They'll get a special $20 off coupon to buy a CEIVA frame, and when they do, you'll get 2 FREE months of PicturePlan® Photo Delivery Service.

Member Eligibility

The CEIVA Referral Program is open only to U.S. residents who are thirteen (13) years of age or older and are CEIVA customers and members in good standing. The Program is void where prohibited. Participation in the Program constitutes the Participant's full and unconditional agreement to these Terms and Conditions. Employees of CEIVA and its related companies, agents, and suppliers, as well as corporate and government accounts with volume-purchase-level agreements are not eligible to participate.

  1. The referring customer must be a paying CEIVA customer or a CEIVA member for 60 days before the referring customer receives their referral credit. A CEIVA customer would earn a complimentary two months of PicturePlan Photo Delivery Service for each referral and the referred customer would receive a $20.00 discount on their purchase of a new CEIVA. The referral credit is linked to the referring customer's monthly service fee. The $20.00 credit applies to the purchase of a new CEIVA Digital Photo Frame bundled with 1 Year of PicturePlan or product pack bundled with 1 Year of PicturePlan. The referring customer and referee cannot be one in the same.
  2. To be eligible, the referring customer must have a frame registered in their account with a current PicturePlan.

Rewards

  1. For you - two months of free PicturePlan service for every person you refer who purchases a new CEIVA Digital Photo Frame bundled with 1 Year of PicturePlan at www.ceiva.com. You can use this 60 days of free PicturePlan for yourself, give it to someone else as a gift, or you can save the gift code and apply when you purchase a new Digital Photo Frame
  2. For the person(s) you refer - $20 off the purchase of a new CEIVA Digital Photo Frame bundled with 1 Year of PicturePlan

Program Rules

The CEIVA Spring Referral Program begins on May 24, 2012 and ends on December 31, 2012.

Below are a list of program rules:

  1. The person you refer must purchase their frame at www.ceiva.com to be eligible for the referral program
  2. Product must be purchased by date indicated on the email or coupon.
  3. Promotional codes must be applied when purchasing and can not be applied after the purchase is made
  4. Referrals must be supplied online prior to purchase
  5. 60 days of free PicturePlan Photo Delivery Service will be applied at the end of your current PicturePlan
  6. If a referring customer cancels their account, all remaining referral credits are forfeited. The referral credit cannot be refunded
  7. The person you refer must register and activate their CEIVA PicturePlan within one month (30 days) of purchasing the CEIVA Digital Photo Frame
  8. Offer may not be used in conjunction with the purchase of products sold by third parties
  9. $20 off coupon can only be used by the person referred, coupon can not be reused or transferred
  10. Offer is not for resale and is not redeemable for cash
  11. Offer cannot be applied to orders already placed with www.ceiva.com
  12. Referrer can give free (60 day) PicturePlan service reward to anyone or choose to hold onto it until he/she purchases a new CEIVA Digital Photo Frame and apply it at that time

Referral Validation

CEIVA checks the validity of all referral orders. The referring customer's e-mail address CANNOT be the same as the referee's e-mail address. The referring customer's physical address CANNOT be the same as the referee's physical address. The referee must register and activate their CEIVA PicturePlan within one month (30 days) of purchasing the CEIVA Digital Photo Frame.

CEIVA customers may complete referral coupons and give them to their friends to encourage them to purchase a CEIVA Photo Digital Frame and PicturePlan or they may direct friends to the Referral page via an e-mail invite. To receive credit for the referral, each referral order must include the CEIVA credit number of the referring customer. If a referred friend does not submit a properly completed referral order during activation, neither the referring customer nor the referred friend will receive a referral credit. Due to the CEIVA privacy policy, CEIVA cannot provide information to the referring customer regarding the status of the referred friend's account.

Modifications and Termination of the Program

CEIVA reserves the right to modify any of the terms and conditions set forth herein - including, but not limited to, the methods through which customers may earn credit and the amount of credit that can be earned by referring friends - at any time, with or without notice, even though these changes may affect a customer's ability to receive their credit.

A customer's participation in the Program constitutes the customer's acceptance of any changes to these Terms and Conditions. Customers are responsible for remaining knowledgeable as to any changes that CEIVA may make to these Terms and Conditions. The most current version of these Terms and Conditions will be available at www.ceiva.com and will supersede all previous versions of these Terms and Conditions.

General Terms and Conditions

To learn how the personal information collected in connection with the Program may be used, individuals should read the CEIVA Privacy Policy. The terms of the CEIVA Privacy Policy are incorporated herein by reference.

CEIVA reserves the right to discontinue the participation privileges of any customer who engages in any fraudulent activity or uses the Program in a manner inconsistent with these Terms and Conditions or any federal or state laws, statutes, or ordinances. Discontinued participation privileges may result in the loss of all accumulated benefits. In addition to discontinuance of participation privileges, CEIVA shall have the right to take appropriate administrative and/or legal action, including criminal prosecution, as it deems necessary in its sole discretion. Credit provided through this program may not be transferred or assigned, and is not transferable upon death, as part of a domestic relations matter or otherwise by operation of law.

CEIVA is not responsible for any incorrect or inaccurate information supplied by customers or referred friends while participating in the Program. All questions or disputes regarding eligibility for the Program, earning of rewards, or a customer's compliance with these Terms and Conditions will be resolved by CEIVA in its sole discretion.

Limitation of Liability

By participating in the Program, Customer acknowledges that technical processing and transmission of information on the CEIVA web site may involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. CEIVA is not responsible for: (a) incorrect or inaccurate transcription of information; (b) problems related to any of the equipment or programming associated with the Program or utilized by the Participant; (c) any human error or printing error; (d) any interruption, deletion, omission, defect, or line failure of any telephone network or electronic transmission; (e) problems relating to computer equipment, software, inability to access the CEIVA web site; or (f) any other technical or non-technical error or malfunction. By participating in the Program, each Customer accepts all responsibility for, and hereby indemnifies and holds harmless CEIVA Logic, Inc., each of its related companies, and each such company's respective officers, directors, employees, shareholders, agents, and successors, and assigns (the 'Released Parties'), from and against any claims that may arise from actions taken by such Participant.

UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL THE RELEASED PARTIES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE PROGRAM, EVEN IF ANY OR ALL OF THE RELEASED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE SUCH EXCLUSIONS MAY NOT APPLY TO YOU. BY PARTICIPATING IN THE PROGRAM, A PARTICIPANT WAIVES ANY AND ALL RIGHTS TO BRING ANY CLAIM OR ACTION RELATED TO SUCH MATTERS IN ANY FORUM BEYOND ONE (1) YEAR AFTER THE FIRST OCCURRENCE OF THE KIND OF ACT, EVENT, CONDITION OR OMISSION UPON WHICH THE CLAIM OR ACTION IS BASED.

Except where prohibited, Customer agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with the Program shall be resolved individually without resort to any form of class action and exclusively by arbitration under the Commercial Arbitration Rules of the American Arbitration Association; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (i.e., only costs associated with participating in the Program), but shall not include attorneys fees under any circumstances; and (c) Member hereby waives all rights to claim punitive, incidental, and consequential damages. If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect.
